Terms of Service
Terms governing the use, subscription and delivery of the ERK service.
Effective date: 5 November 2026
1. Parties and scope
These Terms of Service govern the relationship between ERCAN KILINC KILINC HAFRIYAT (“ERK”, “we”), the provider of the ERK application and related web services, and the company, business and authorised users using the service (“Customer”, “User”).
ERK is commercial software for managing construction-site, excavation, transport and hourly-work operations, personnel and document records, financial tracking and reports by company and project.

2. Accounts and permissions
The Customer is responsible for keeping account information accurate and current and for correctly assigning user roles, company, project, vehicle and module permissions. Account credentials and verification codes must not be shared.
Company owners and authorised managers manage invitations, roles and project access. Field users may access only the records and projects assigned to them. Prices, revenue, debt and collection information is shown only to authorised users.
3. Modules and subscriptions
Excavation, Transport, Hourly Work and Construction Site modules may be activated separately. Modules not purchased are not shown to the company; modules not enabled for a project are not shown to users in that project. Reporting, control, personnel and supporting functions are provided according to the active module and the user’s permissions.
The subscription term, price, enabled modules, user or project limits and renewal terms are stated in the applicable quotation, order, agreement or invoice. Taxes and payment terms are governed by the relevant commercial document. Downloading the application from Google Play does not itself grant access to paid modules or a subscription unless separately agreed.
4. Use and record responsibility
The Customer is responsible for the accuracy and lawful use of personnel, customer, subcontractor, vehicle, price, work, collection, document and other data entered in the application, and for obtaining all required notices and permissions. The records must not be assumed to replace statutory accounting, tax, occupational-safety or official-book obligations.
Financial and operational reports depend on data entered by authorised users and on configured unit prices. Missing, incorrect or unsynchronised records may affect results. Finalised records and price changes are subject to the application’s permission and audit rules.
5. Acceptable use
The service must not be used for unlawful activity, unauthorised access, access to another company’s data, malware distribution, service disruption, reverse engineering or circumvention of security controls. Personal data and business documents should be uploaded only where necessary.
6. Availability and third parties
We use reasonable efforts to keep the service secure and available. Temporary interruptions may result from maintenance, updates, network, device or internet problems, force majeure or third-party outages.
Third-party services may be used for authentication, databases, file storage, notifications, email and store distribution. Their terms and outages may affect the relevant functions.
7. Data, privacy and backups
The processing of personal data and the scope of account deletion are explained in the Privacy Policy. As a controller of its employee and business information, the Customer is responsible for applicable notices, permissions and lawful processing.
The Customer should retain exported copies of important commercial records and any documents that must be retained by law. Offline records are synchronised when a connection is available; deleting a device or account before synchronisation may cause data loss.
8. Intellectual property
Rights in the ERK software, design, brand, documentation and service infrastructure belong to the provider or the relevant rights holders. The Customer receives a limited, non-transferable right to use the service for its own business during the subscription term. The Customer retains ownership of the business data it enters.
9. Suspension and termination
Access may be restricted or suspended for non-payment, security risk or use contrary to law or these Terms, subject to applicable notice and mandatory law. Access to paid modules may end when the subscription expires.
Deleting a user account does not automatically delete the company’s business records. Account, company and data-deletion requests are handled under the Privacy Policy and the application’s permission and record-retention rules.
10. Limitation of liability
ERK does not guarantee the accuracy of user-entered data or the outcome of commercial decisions based on that data. To the extent permitted by mandatory law, ERK is not liable for indirect loss, loss of profit or business interruption. Liability for intent, gross negligence and matters that cannot legally be limited remains unaffected.
11. Changes and notices
These Terms may be updated when the service or applicable law changes. Material changes will be communicated through the application, website or registered contact channels. The current version is published on this page.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye. Without prejudice to mandatory consumer protections, the courts and enforcement offices of Eskişehir have jurisdiction over commercial disputes.
